WEG products, when operated under the conditions stipulated by WEG in the operating manual for such product, are warranted against defects in workmanship and materials for twelve (12) months from the date of the invoice or for eighteen (18) months from manufacturing date, whichever occurs first. Should the product have been subjected to misuse, misapplication, neglect (including without limitation inadequate maintenance, accident, improper installation, modification, adjustment, repair or any other cases originated from inadequate applications) this warranty will be immediately void.  Warranty will also be void if the following items are not fulfilled accordingly:

Proper transportation, handling and storage;

Repair and/or replacement effected only by personnel duly authorized in writing by WEG;

Correct installation based on the specified ambient conditions and free of corrosive gases;

The failed product be available to the supplier and/or repair shop for a required period to detect the cause of the failure and corresponding repair;

Operation under motor capacity limits;

Observation of the periodical maintenance services;

Immediate notice by the purchaser about failures accured and that these are accepted by WEG as manufacturing defects.

WEG will neither be responsible for any expenses incurred in installation, removal from service, consequential expenses such as financial losses, transportation costs as well as ticket and accommodation expenses of a technician when this is required by the customer. The repair or replacement of parts or components, when effected by WEG within the warranty period do not give warranty extension, unless otherwise expressed in writing by WEG.

This constitutes WEG’s only warranty in connection with the WEG product and is in lieu of all other warranties, expressed or implied, written or oral. There are no implied warranties of merchantability or fitness for a particular purpose that apply to a WEG product. No employee, agent, dealer, repair shop or other person is authorised to give any warranties on behalf of WEG nor to assume for WEG any other liability in connection with any of its products. Should this happen without WEG’s authorisation, the warranty is automatically cancelled.

Except as specified in the foregoing paragraph, WEG shall have no obligation or liability whatsoever to the purchaser, their employees, third parties, other equipment or installations, including without limitation any claims for consequential damages or labour costs.

The purchaser hereby agrees to indemnify and hold WEG harmless from any actions, other than the cost of replacing or repairing the defective product as specified in the foregoing paragraphs, arising directly or indirectly from the acts, omissions or negligence of the purchaser in connection with or arising out of  the testing, use, operation, replacement or repair of any product sold or furnished by WEG to the purchaser.
